This website, varnitam.com, is operated individually by Varnitam Arts, trading under the brand name Varnitam. Throughout these Terms, “Varnitam”, “we”, “us” and “our” refer to Varnitam Arts.

By accessing this website, creating an account, placing an order, purchasing an artwork or otherwise using our services, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy and any other policies referenced on this website.

If you do not agree with these Terms, please do not use the website or place an order.

Eligibility and use of the website

You must be legally capable of entering into a binding contract under applicable law to purchase from Varnitam.

You agree to use this website only for lawful purposes. You must not use the website in a manner that infringes intellectual-property rights, compromises website security, introduces malicious software, attempts unauthorised access, interferes with another user’s use of the website, or otherwise violates applicable law.

We may restrict or terminate access where we reasonably believe the website is being misused.

Our artworks and products

Varnitam offers artworks and related products that may include original works, limited-edition works, art prints, reproductions, stretched canvases, framed artworks, unframed artworks and other art-related products.

The exact nature of each product will be stated on its product page.

Please review the product description, dimensions, medium, material, framing option, edition information and other specifications carefully before purchasing.

Where an artwork is described as a limited edition, the edition size or available quantity shown on the relevant product page applies to that particular edition or variant.

A limited-edition product may become unavailable permanently once its stated edition has sold out.

Artwork images, colour and appearance

We make reasonable efforts to present product photographs, artwork colours, textures and dimensions accurately.

However, the appearance of colour may vary depending on your screen, device, brightness settings and display calibration.

Printed colours may also differ slightly from their digital representation.

Natural materials, printing processes, canvas stretching, framing and hand-finishing may result in minor variations between individual pieces. Such reasonable variations are part of the character of the product and are not necessarily defects.

Room mock-ups and lifestyle images may be used to help demonstrate scale and styling. Unless expressly stated otherwise, they are illustrative and should not be relied upon as precise measurements.

Always refer to the dimensions stated on the product page.

Product availability

All products are subject to availability.

Some artworks are made in small quantities, made to order or offered as limited editions.

Adding a product to your cart does not reserve it.

An order is not finally accepted until we have successfully received payment, verified the order and sent you an order confirmation or acceptance notice.

If an artwork becomes unavailable after you place an order, we will contact you and arrange an appropriate refund or alternative where applicable.

Prices

Product prices are displayed in Indian Rupees unless otherwise stated.

Prices may change from time to time.

Any applicable taxes, shipping charges or other fees will be shown in accordance with applicable law and our checkout process.

A price change will not normally affect an order that has already been accepted, except where there has been an obvious pricing or technical error.

Errors in pricing or product information

We endeavour to keep product descriptions, availability and pricing accurate.

Occasionally, typographical, technical or administrative errors may occur.

If an obvious error affects an order, we may contact you before fulfilment to correct it, offer an alternative or cancel and refund the affected order.

Nothing in this clause affects rights available to consumers under applicable law.

Payments

Payment must be made using one of the payment methods offered at checkout.

Payments may be processed through third-party payment gateways or financial-service providers.

Your use of those payment services may also be subject to the provider’s applicable terms and policies.

We reserve the right to delay or refuse an order where payment has not been authorised, where fraud is suspected or where additional verification is reasonably required.

Orders

When you place an order, you confirm that the information you provide is complete and accurate.

We may refuse, limit or cancel an order where reasonably necessary, including where:

the product is unavailable; payment cannot be verified; incorrect pricing or product information has been published; an order appears fraudulent; unusually large quantities appear intended for unauthorised resale; or fulfilment is not reasonably possible.

If we cancel an accepted and paid order, any amount due to you will be refunded through the applicable payment method, subject to our payment provider’s processing timelines.

Shipping and delivery

Shipping and delivery are governed by our separate Shipping Policy.

Any dispatch or delivery dates shown on the website are estimates unless expressly stated otherwise.

Please provide a complete and accurate shipping address.

We are not responsible for delays caused by incorrect information provided by the customer.

If an order arrives visibly damaged, please photograph the outer packaging and artwork and contact us as soon as reasonably possible so that we can assist you.

Your statutory consumer rights remain unaffected.

Returns, refunds and cancellations

Our Returns & Refunds Policy forms part of these Terms.

Eligibility for return may differ according to the type of product.

For example, customised, personalised, made-to-order, custom-sized or specially framed artworks may have different return conditions from standard products where permitted by law.

However, nothing in our policies is intended to exclude rights that consumers have under applicable Indian consumer law, including where goods are defective, damaged, incorrect, spurious or materially different from what was represented. Indian e-commerce rules specifically address return, refund, exchange and grievance information and prohibit unfair trade practices.

Frames and made-to-order options

Where framing, mounting, stretching or custom sizing is offered, the relevant specifications will be displayed on the product page.

Frame grain, wood tone and other natural-material details may vary slightly from product photographs.

Custom-made products may begin production soon after an order is placed. Accordingly, cancellation may not always be possible after production has commenced, subject always to applicable consumer law and the terms stated in our Returns & Refunds Policy.

Intellectual property

Unless otherwise indicated, the Varnitam name, logo, website design, photographs, text, graphics, product presentation and other website content are owned by or licensed to Varnitam and are protected by applicable intellectual-property laws.

Artwork copyright may belong to Varnitam, an artist, a licensor or another rights holder, depending on the particular artwork.

Purchasing an artwork does not give you permission to reproduce, scan, print, copy, commercially exploit, merchandise, distribute, licence, modify or create derivative commercial products from the artwork.

You may display the physical artwork you purchase for ordinary personal or lawful business-interior purposes.

Any commercial reproduction or licensing requires written permission from the relevant copyright owner.

Third-party intellectual property

Certain artworks may refer to artistic traditions, cultural styles, historical subject matter or legally licensed/public-domain source material.

Where third-party intellectual-property rights apply, those rights remain with their respective owners.

Nothing on this website should be interpreted as transferring third-party intellectual-property rights to a purchaser.

Accounts

You may be able to create a customer account.

You are responsible for maintaining the confidentiality of your account information and password and for activity carried out through your account.

Please inform us promptly if you believe your account has been accessed without permission.

We may suspend accounts used for fraudulent, unlawful or abusive activity.

Reviews, photographs and submissions

If you submit a product review, testimonial, photograph or other content to Varnitam, you confirm that you have the right to provide that material.

You remain responsible for your submission.

Unless otherwise agreed, you grant Varnitam a non-exclusive, royalty-free permission to display, reproduce and use your submitted review or customer photograph for operating and promoting our business, subject to applicable privacy and intellectual-property laws.

We may remove submissions that are unlawful, abusive, misleading, infringing, irrelevant or otherwise inappropriate.

Prohibited activities

You may not use this website to engage in illegal activity, violate intellectual-property rights, impersonate another person, submit fraudulent information, scrape the website at an unreasonable or harmful scale, distribute malware, circumvent security measures or interfere with the operation of the website.

We may take appropriate action where misuse occurs.

Third-party links and services

Our website may contain links to third-party websites, social platforms, payment providers, logistics providers or other external services.

These services are operated independently.

We are not responsible for third-party websites or services that are outside our reasonable control.

This clause does not reduce any statutory rights available to consumers.

Force majeure

We will not be responsible for a delay or failure caused by circumstances reasonably beyond our control, such as natural disasters, transport disruption, strikes, governmental restrictions, severe network failures, acts of war or similar events.

Where such circumstances affect an accepted order, we will take reasonable steps to communicate with you and fulfil, reschedule or refund the order as appropriate.

No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
